Brain Injury

Swartz & Lynch LLP

Our Boston Attorneys Advocate for Victims of Brain Injuries

Compassionate counsel and vigorous representation for seriously injured clients

The human brain makes up only two percent of our body weight, yet it is central to everything we do: It allows us to breathe and to move; it allows us to think, imagine and feel; and it is where our memories are stored. So any injury to the brain is serious, with often devastating consequences.

At Swartz & Lynch LLP in Boston, our attorneys help people throughout Massachusetts who were harmed in car, truck and motorcycle accidents, slip and fall accidents, construction site accidents and other accidents that left them seriously injured. We believe that if you have suffered a brain injury as the result of someone else’s negligence or reckless behavior, you are owed more than an apology. You are owed compensation.

Traumatic brain injury causes and complications

According to the Centers for Disease Control and Prevention (CDC), 1.7 million Americans a year suffer a traumatic brain injury (TBI) as the result of an accident. The CDC lists two types of traumatic brain injury:

  • A penetrating, or open, wound is one in which the skull and the meninges (the membranes that surround and protect the brain and spinal cord) have been penetrated by a bullet or any other sharp object.
  • A closed wound is the result of the brain moving within the skull. Car and other motor vehicle accidents, slip and fall accidents and sustaining a strike to the head are the most common causes of this type of brain injury.

When we sustain a brain or spinal injury, we face a number of unique medical problems. For instance, cells in the central nervous system have a higher rate of metabolism than do most of the other cells in our body. And complications are greater in injuries where there is a loss of blood flow, which can result in further damage to the brain or spine.

Problems associated with traumatic brain injury include:

  • Memory loss and decreased attention span
  • Weakness and decrease in balance and coordination
  • Impairment in vision, hearing and touch
  • Depression, anxiety, impulse control, aggression or changes in personality

How we help you recover damages

Our lawyers work tirelessly to obtain compensation for your pain and suffering as well as medical expenses, lost wages, loss of future earning capacity and more by filing a personal injury lawsuit on your behalf. It is estimated that medical expenses and indirect costs of TBI, such as loss of productivity, totaled $76.5 billion in the United States — and that was in the year 2000. Consider, too, that the highest incidence of accidental brain injuries are in children under the age of four, teenagers aged 15 to 19, and adults age 64 and over.  The costs can be staggering.

One of the most important factors in a successful brain injury lawsuit is valuing your claim. Some damages are easy to calculate: your medical expenses and lost wages, for example. But how do you put a price on pain and suffering, mental anguish and loss of quality of life? Your Swartz & Lynch attorney may turn to economists, medical specialists and others to help build your case. Other factors that go into determining the value of your case include the severity and complexity of your injury, the amount of the award made in cases similar to yours — and, ultimately, a jury.

Chances are that there is a large gap between what the insurance company wants to offer and the amount of compensation you deserve. By relying on the evidence, expert testimony and our courtroom skills, we work to get you the maximum compensation possible.
