Drunk Driving Victim

Boston Attorneys Dedicated to Helping Drunk Driving Victims Obtain Maximum Compensation

On average, one person dies every 48 minutes from an alcohol-related car accident

Motor vehicle accidents are the leading cause of unintentional death in the United States. And drunk-driving statistics show that nearly one-third of those fatalities were related to somebody drinking and then getting into the driver’s seat. Moreover, for every fatality, there are many more people who suffer catastrophic injuries.

Few car accidents are more frightening than those caused by drunk drivers because the behavior of those who drive under the influence is so unpredictable. People who drive impaired may drive on the wrong side of the road, fall asleep at the wheel, run a red light, or cause a speeding accident. Whatever the reason, you should never have to pay the price of being a drunk-driving victim. At Swartz & Lynch LLP in Boston, our attorneys make sure that if you have been injured by a drunk driver, that driver is held liable.

What constitutes drunk driving, and how is a victim compensated?

A driver is legally drunk with a blood alcohol content (BAC) of .08 or higher. This is commonly referred to as driving under the influence (DUI) or driving while intoxicated (DWI), but in Massachusetts it’s called operating under the influence (OUI). Anybody who is arrested for drunk driving faces criminal charges and may also be liable for damages under a civil personal injury lawsuit. A successful claim allows a victim to receive compensatory damages for:

  • Medical expenses, including those for hospitals, surgeons, physicians and medication
  • Future medical expenses
  • Physical therapy, counseling and rehabilitative services
  • Property damage
  • Lost wages and loss of earning capacity
  • Pain and suffering

As your personal injury lawyers, we pursue these damages if warranted.

Who can file a claim as a victim of drunk driving?

If you were injured in a car accident, a tractor trailer accident, a motorcycle accident, or any other type of vehicular incident that involved an alcohol- or drug-impaired driver, you can file a claim against his or her insurance company. If a family member was killed by a drunk driver, you may be able to file a wrongful death claim.

The AV-rated attorneys at our personal injury law firm are committed to getting the maximum available compensation for people injured by drunk drivers — and we’ve successfully done so for clients throughout Massachusetts for more than a decade.
