Spinal Injury

Swartz & Lynch LLP

Seasoned Boston Attorneys Handle Serious Spinal Injury Cases

You deserve full and fair compensation for an accident-related spinal cord injury in Massachusetts

It can happen in a moment: a fall, a car crash or a workplace or construction site accident can result in a spinal injury, changing your life forever.

It’s estimated that there are between 11,000 and 12,000 people who will suffer a spinal injury this year. Nationwide, there are currently as many as 270,000 people living with the effects of this devastating type of injury. And while nobody can turn back the clock to that moment before the accident happened, at Swartz & Lynch LLP, our Boston attorneys fight to get you justice.

The costs associated with a spinal cord injury (SCI) are high. Lifetime medical and living expenses for SCI injuries to a 25-year-old are estimated to be:

  • $4,543,182 for spinal damage to vertebrae in the neck (C1–C4) that results in high quadriplegia
  • $3,319,533 for spinal damage to the C5–C8 vertebrae that results in low quadriplegia
  • $2,221,596 for spinal damage that results in paraplegia

Those figures do not even include lost wages or loss of earning capacity, nor do they account for pain and suffering and other nonmonetary damages. But as your personal injury lawyers, we take everything into account. We believe that those responsible for causing you harm should be held accountable for what they did, and we fight to get you every penny of compensation you are owed.

How spine injuries happen

The spine is part of the central nervous system. When nerves within the spinal canal are damaged or you suffer a brain injury, there is a disruption in communication between the brain and the nerves in your spine, affecting your coordination and ability to feel.

Injured nerve cells in your peripheral nervous system can usually repair themselves, and you will not suffer permanent or debilitating damage. However, the nerves in the central nervous system cannot regenerate, resulting in more catastrophic injuries such as paralysis. Men are nearly twice as likely to suffer a severe spine injury as women: Males account for 61 percent of all SCIs.

According to the National Spinal Cord Injury Statistical Center (NSCISC):

  • 39.2 percent of SCIs are caused by motor vehicle accidents
  • 28.3 percent are caused by falls
  • 14.6 percent are due to violence
  • 8.2 percent are sports-related

Because of the immense costs associated with spinal injuries, insurance companies may take advantage of the confusion and anxiety that victims and families feel following an accident and attempt to get you to sign off on a quick settlement — one that is inevitably too low.
