Who can file a wrongful death claim?
Personal injury lawsuits are generally filed by the person who was injured or, in the case of a minor, the parent or guardian. In a Massachusetts wrongful death case, a suit is filed by an administrator or executor of the estate on behalf of a surviving spouse, children or parents. If the deceased was unmarried and had no children or living parents, then siblings or other close relatives may be eligible for compensation.
