Who can file a wrongful death claim?

Personal injury lawsuits are generally filed by the person who was injured or, in the case of a minor, the parent or guardian. In a Massachusetts wrongful death case, a suit is filed by an administrator or executor of the estate on behalf of a surviving spouse, children or parents. If the deceased was unmarried and had no children or living parents, then siblings or other close relatives may be eligible for compensation.

Massachusetts allows survivors to recover monetary and non-monetary damages, including physician and hospital bills associated with a fatal accident, funeral expenses as well as the “services, protection, care, assistance, society, companionship, comfort, guidance, counsel and advice” of the loved one. If the deceased had any conscious pain and suffering prior to his/her death, then the estate can make a recovery for the pain and suffering.
