Speeding Accident

Boston Attorneys Seek Full Compensation for Speeding Accident Injuries

Holding speeders accountable for the injuries they cause

Love them or hate them, there is a reason why there are speed limits. The Massachusetts Department of Transportation (MassDOT) states that its goal is to set a speed limit that is “both acceptable to the prudent driver and enforceable by police.” Above all, though, speed limits are meant to keep drivers safe.

Those of us who drive any of the streets or highways in and around Boston know that speeding is rampant. When drivers who exceed the speed limit cause serious accidents, speeding becomes tragic. In fact, the National Highway Traffic Safety Administration (NHTSA) reports that about 32 percent of all motor vehicle crash fatalities are related to speeding. If you’ve been injured in an auto accident caused by a speeding driver, the liable party should be held accountable. The personal injury attorneys at Swartz & Lynch LLP help make sure that they are.

With 74 years of collective experience helping people injured by negligent drivers, we know what to look for in a speeding accident. And we know how to fight insurance companies to ensure that you recover damages for your injuries.

What makes speeding so dangerous

A number of factors are considered when setting a speed limit: among them, an area’s population density, surface conditions of the roadway, roadway width, and pedestrian activity. Speed limits are established based on what’s known as the 85th percentile of speed, which determines the maximum safe speed of a particular roadway under ideal driving conditions.

When a driver exceeds the speed limit, two things are certain:

  • Speeding makes it harder to stop. An average passenger car traveling 55 miles per hour takes about 300 feet to arrive at a complete stop. Double that speed, and it can take as much as four times that distance to stop.
  • A speeding vehicle hits with more force. Once again, the laws of physics apply —the force of impact increases with the square of the increase in speed.

Speeders, who may also be distracted drivers or drunk drivers, are dangerous. Uninsured motorists involved in speed-related car accidents create additional problems because they put you in a position of placing a claim against your own insurance company if you have only liability insurance and no uninsured or underinsured coverage.

Injuries sustained in accidents caused by speeding are often severe and may include traumatic brain or spinal cord injuries, burns, damage to internal organs or other injuries that result in a lifetime of chronic pain. As your personal injury lawyers, we cannot undo the harm that a speeder has caused, but we can get you the compensation you need and deserve.
